These Terms of Service ("Terms") govern your access to and use of DESGRACIADO (the "Site"), operated by Palovisto LLC ("we," "us," or "our"). By accessing or using the Site, or by submitting any content, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. What the Site is

DESGRACIADO is an opinionated news aggregator and a platform for user-submitted content, presented in a satirical, tabloid style. It collects publicly available news headlines and links, presents editorial commentary, and lets users submit their own posts. The Site is intended as commentary, satire, and entertainment.

2. Eligibility

You must be at least 18 years old to use the Site or submit content. By using the Site, you represent that you meet this requirement.

3. Aggregated content and third-party sources

Headlines, snippets, and links to third-party news sources are provided for the purpose of commentary and to direct readers to the original source. All rights in third-party content remain with their respective owners. We do not claim ownership of third-party material and are not responsible for its accuracy; links are provided to the original publishers, who retain all rights.

4. Opinion and satire

Editorial commentary, headlines, category labels, ratings, and "verdicts" on the Site are statements of opinion, satire, and rhetorical hyperbole — not assertions of objective fact. Category labels and shame-themed framing are a stylistic device and are not intended as literal factual claims about any identifiable person. Nothing on the Site should be read as a factual accusation of wrongdoing beyond what a linked, independent source reports.

5. User submissions

"User Content" means anything you submit, upload, or post to the Site. You retain ownership of your User Content. By submitting it, you grant Palovisto LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute that User Content in connection with operating and promoting the Site.

By submitting User Content, you represent and warrant that:

• you own or have all rights necessary to submit it and to grant the license above;
• it does not contain false statements of fact about any identifiable person, and is not defamatory, libelous, or a violation of privacy;
• it does not harass, threaten, stalk, or reveal private information ("doxxing") about any private individual;
• it does not infringe any copyright, trademark, or other intellectual property or proprietary right;
• it is not unlawful, and does not depict or promote illegal activity; and
• you have consent from any identifiable person featured, where required by law.

6. Prohibited content and conduct

You agree not to submit or do any of the following:

• content that is defamatory, harassing, threatening, or hateful;
• content that reveals another person's private or identifying information;
• sexual content involving minors, or any content that sexualizes minors, in any form;
• content that infringes intellectual-property or privacy rights;
• unlawful content, or content that facilitates unlawful acts;
• spam, malware, or automated scraping of the Site without permission.

7. Moderation; no obligation to monitor

We do not pre-screen User Content and are under no obligation to monitor it. We may, at our sole discretion and without notice, remove, refuse, or restrict any content for any reason, including content we believe violates these Terms. Consistent with Section 230 of the U.S. Communications Decency Act, we act as a provider of an interactive computer service and are not the publisher or speaker of User Content provided by others.

8. Reporting content

If you believe content on the Site is unlawful, defamatory, infringing, or otherwise violates these Terms, use the "Report" control on the relevant post or contact us at admin@palovisto.com. For copyright complaints, see our DMCA / Copyright Policy. We aim to review valid reports promptly.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site will be accurate, complete, reliable, or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALOVISTO LLC, ITS OWNERS, MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Palovisto LLCand its owners, members, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Site, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute arising from these Terms or the Site.

13. Changes

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
